A qualified domestic relations order is an order filed with the court requesting a right to part or all of the retirement benefits of a 401k or similar plan from a former spouse. QDRO’s are common during a divorce in order to receive an equitable distribution between spouses. But QDRO's can be done after a divorce has been completed.
Unfortunately, a divorce decree issued is often insufficient by itself to divide certain retirement accounts. The QDRO needs to be approved and signed by the judge in addition to the decree of divorce. After, the QDRO must be sent to the retirement plan administrator requesting division of the retirement account.
We will obtain all the required information about the retirement plan. Then we will create and submit the QDRO to the judge and retirement plan administrator on you behalf.
